Terms of Service: doctor app
These terms apply to the Licit Note doctor app, provided by Permason Technologies ("we" or "us"). By creating an account or using the app, you agree to them. If your clinic has its own agreement with us for Licit Note and it differs from these terms, the clinic agreement applies.
These are the terms shown in the doctor app, under Settings, Terms of Service.
1. Who can use the app
The app is for medical practitioners with current registration with the Health Professions Council of South Africa (HPCSA). Before you can see patients or issue notes, we verify your HPCSA registration and your clinic approves your membership.
The details you give us must be accurate, and you must keep them up to date.
2. Your account
Your account is for you alone. Keep your password private and don't let anyone else use your account. Every note is recorded against the account that issued it, so anything done while signed in to your account is treated as done by you.
If you think someone else has used your account, use Settings, Password & security, Sign out of all devices, change your password, and tell us at support@licitnote.com.
3. Issuing notes
You are responsible for the clinical content and accuracy of every note you issue, and for issuing notes only for patients you have seen. Licit Note records and verifies notes. It doesn't give medical advice or make clinical decisions. That includes any days off you give: the note states the patient is unfit to attend work or school for those days.
When you issue a note, our server creates it with a unique QR code and link. The note is valid for the period shown when you issue it (currently 5 days, or until the days off end if that's later). After that it is marked as archived and still verifies as genuine.
4. Reissuing and revoking
Reissuing gives a note a new QR code and link, and the old ones stop working.
Revoking is permanent. Anyone who checks a revoked note sees that it is no longer valid, and it can't be restored.
Every issue, reissue, and revocation is recorded with the time and the doctor who did it. That record can't be edited or deleted.
5. Sharing notes
Share a note's QR code or link only with the patient it is for, or with people the patient asks you to share it with. The app can prepare a WhatsApp message to the patient for you; nothing is sent until you send it.
6. Patient information
Use patient information in the app only to care for the patient and issue their note. Handle it in line with POPIA, the HPCSA's rules on confidentiality, and your clinic's policies. Don't copy it out of the app except as your practice requires.
The Privacy Policy explains what information the app uses and who can see it.
7. What you must not do
- Issue a false or misleading note.
- Try to see information you aren't allowed to see, or get around the app's security.
- Interfere with the service, or copy, change, or take apart the app.
- Use the app for anything unlawful.
8. Availability
We work to keep Licit Note available, but it may be interrupted for maintenance, updates, or reasons outside our control. Issuing a note needs an internet connection. If the app can't confirm that a note was issued, check the Notes tab before trying again.
9. Suspending or closing an account
We may suspend or close an account that breaks these terms, whose HPCSA registration lapses, or that a clinic removes. You can ask us to close your account in Settings, Delete account.
Notes you issued, and their records, are kept after an account closes so they stay verifiable.
10. Ownership
The app and the Licit Note name and logo belong to Permason Technologies. We give you a personal right to use the app in your practice, which you can't transfer to anyone else.
11. Liability
As far as the law allows, the app is provided as it is. We aren't liable for indirect or consequential loss, for clinical decisions, for incorrect information entered by you or your clinic, or for events outside our reasonable control. Nothing in these terms limits rights you have by law that can't be limited.
12. Changes to these terms
We may update these terms. We will change the date at the top and tell you in the app before significant changes take effect. If you keep using the app after that, you accept the updated terms.
13. Governing law
These terms are governed by the law of the Republic of South Africa.
